TERMS OF USE - CONSUMERS

What is Fastlane

The app functions as a "smart wallet" enabling remote ordering and automatic payments at specific locations or events. Users can download access passes, transfer digital currency, and receive delivery status updates.

Installation & Account Setup

Download from App Store (iOS) or Google Play Store (Android). Users must be 18+ or have parental consent. The app requests permissions for: camera (QR codes/AR), GPS location data, notifications, and Bluetooth connectivity.

Service Provision

The Fastlane App is provided 'as is' without guarantees regarding functionality, security, or information accuracy. Users assume all installation and usage risks.

Payment Processing

Payments process through Mollie Payment. Fastlane merely facilitates transactions between users and vendors — not responsible for order fulfillment disputes. Direct vendor contact required for complaints.

Costs

App download is free. Credit loading incurs transaction fees. Withdrawal fees apply when refunding remaining balance to bank account.

Liability Limitation

Fastlane excludes liability for direct/indirect damages from app use, transaction handling, or third-party actions — except in cases of conscious recklessness or intent by leadership.

Account Termination

Users delete the app to end service. Remaining wallet balance requires manual withdrawal before deletion; automatic refund doesn't occur.

Data Processing Purposes

The organization processes personal data for:

Data Retention

Most marketing/service data retained up to 36 months after final app usage. Financial records kept 7 years. Job applications retained 3 years.

Response Timeline

TERMS OF USE - VENDORS/ENTREPRENEURS

Scope

These terms govern all vendor use of Fastlane PoS Software and related services for processing consumer transactions at events or locations.

What Fastlane Provides

The solution includes PoS Software for vendors plus consumer-facing app functionality. Vendors manage menus and product listings; Fastlane facilitates transactions only.

Software Activation

Vendors must promote app download through marketing channels. Vendors request permissions for GPS, notifications, and Bluetooth during activation (not mandatory but recommended).

Vendor Obligations

Vendors must: use software lawfully per regulations, possess rights to all uploaded content, ensure legal product/service delivery, and comply with consumer protection laws. Vendors indemnify Fastlane against claims arising from non-compliance.

Prohibited Actions

Vendors cannot modify, copy, damage, or overburden the PoS Software.

Payment Processing

Stripe handles consumer payments. Vendors establish personal Stripe accounts receiving transaction proceeds. Stripe's terms apply. Fastlane is no party to consumer-vendor contracts — only facilitates transactions.

Pricing & Billing

Prices stated in euros excluding VAT. Fastlane may adjust pricing (except during active projects under signed agreements). Monthly invoicing; vendors must pay within 14 days after invoice date. Late payment incurs 2% monthly interest plus collection costs.

Liability Exclusion

Fastlane excludes liability for damages except where caused by conscious recklessness or intent of Fastlane leadership or demonstrable technical malfunction of Fastlane.

Contract Duration

Agreements typically run for event duration only. Upon termination, Fastlane may deduct outstanding fees from pending vendor payments.

Intellectual Property

Fastlane retains all IP rights. Vendors receive limited, non-exclusive, revocable license solely to exercise rights and fulfill obligations during contract term.

Data Processing

Vendors consent to data processing per applicable privacy law. Vendors processing consumer data remain responsible for GDPR compliance; Fastlane acts as processor. Vendors indemnify Fastlane against data-related claims.

Modifications

Fastlane may modify terms and software unilaterally. Continued use constitutes acceptance. Vendors must use current software versions.

Jurisdiction

Dutch law applies. Disputes exclusively heard by Amsterdam District Court.
